Zeitarbeit als Sprungbrett? Diese Chancen bietet sie

Would you like to gain work experience quickly, return to work after a break or explore different areas of work?

Temporary agency work – also known in German as Arbeitnehmerüberlassung or Leiharbeit – could be an option

Under this arrangement, you work for a staffing provider and are assigned to another company for an agreed period. Whether this model suits you depends on your career goals, the level of predictability you want and the terms of the specific employment contract.

At its core, the arrangement involves three parties

Temporary agency work is regulated by law in Germany.

However, the details vary depending on the country, employment contract and applicable collective agreement. Always check the specific terms of your offer before accepting it.

Benefits of temporary agency work for your career development

Temporary agency work can make it easier to access different roles, companies and industries. These six points can help you assess your options.

Staffing providers often fill positions that become available at short notice or require specific skills. With a complete candidate profile, you can be considered for several suitable assignments.

If your CV is not up to date, it helps to gather details of your work experience, skills, availability, preferred working hours and work location in advance. Trenkwalder offers

tips for applying without an up-to-date CV

This can be particularly useful if you want to start or return to work after vocational training, university, parental leave, illness or a change in career direction. However, temporary agency work still requires careful consideration: clarify the duties, work location, working hours and expected length of the assignment in advance.

You can explore different positions without starting an entirely new application process for each role.

2. An employment contract, pay and social protection

Your employment contract is with the staffing provider, rather than the client company. Among other things, it sets out arrangements for pay, annual leave, working hours, sickness and termination of employment.

In Germany, temporary agency work is governed by legislation including the German Temporary Employment Act (Arbeitnehmerüberlassungsgesetz) and, depending on the employer, industry collective agreements

Your pay and any additional payments depend on your contract, duties, assignment and the applicable collective agreement provisions.

You know who to contact with questions about payroll, annual leave or social insurance

3. Gaining work experience in different area

Temporary work can provide opportunities in fields such as

The opportunities available depend on your qualifications, region and current vacancies.

If you are still exploring which duties suit you, different assignments can help you find your direction. Keep a record of the tasks that suit you, the skills you develop and the working conditions that help you perform well.

You can demonstrate specific experience on your CV and define your career goals more clearly

4. The possibility of joining the client company directly

During an assignment, you and the client company get to know each other through everyday work. Some companies later offer agency workers direct employment.

However, direct employment does not automatically follow an assignment and should not be taken for granted. Speak openly with your contact person if you are interested in a permanent role with the client company.

You can demonstrate how you work, collaborate with the team and take on responsibilities

5. Making use of training and qualifications

Before starting an assignment, ask which qualifications are important for the role and whether training opportunities are available. These might include safety briefings, language courses, technical training or qualifications such as a forklift licence.

Funding and training opportunities depend on the employer, collective agreement, employment contract and, where applicable, public funding bodies

A relevant qualification can broaden your assignment options and support a move into a new field of work

Different assignments may suit your circumstances, for example if you are planning a career change or initially want to gain experience in a new area. At the same time, check whether the working hours, commute and assignment length fit your everyday life.

Each assignment brings you into contact with new colleagues and workplace contacts. Good connections can be useful later, for example when you need a reference or hear about a vacancy.

You gain insights into different ways of working and can expand your professional network.

Temporary agency work or direct permanent employment: which suits you?

Whether temporary agency work or direct permanent employment is a better fit depends on your goals. Applying directly may make sense if you want to work for a particular company over the long term. Temporary agency work may suit you if you want to gain experience or explore different fields of work.

Compare more than just pay. Consider working hours, commuting distance, contract length, additional payments, annual leave, training and everyday duties

How can you recognise a reputable staffing provider?

A reputable staffing provider answers your questions clearly and gives you the contract documents in good time. You can check the following points:

Read the entire employment contract before signing. Clarify pay, working hours, annual leave, notice periods, work location and any additional payments.

Ask which collective agreement provisions apply to your employment.

In Germany, these may be set out in a Tarifvertrag

Clarify who to contact with questions about your assignment, working hours or payroll.

Ask for an explanation of your duties, requirements, workwear, safety rules and start date before the assignment begins.

Ask about training or further development if you still need particular skills or qualifications for a role.

Prepare for an initial conversation by describing your experience through specific examples and noting down questions about duties, working hours and work location. A complete overview of your experience, skills and availability helps you prepare a clear introduction. Trenkwalder provides

that can also help you prepare for these conversations

Conclusion: consider whether temporary agency work suits your next step

Temporary agency work can help you gain work experience more quickly, explore new duties and build connections with companies. However, your employment contract, pay and the applicable rules vary depending on the country, assignment and agreement.

If you are considering temporary agency work, first check the contract and the terms of the specific assignment. Note down any questions about duties, working hours, pay and development opportunities before making your decision.

Berufserfahrung in verschiedenen Bereichen sammeln

Legal certainty begins before the job posting

It’s not just the candidate search that determines the success of an international hire—it’s the early clarification of the employment model, residency status, and employer obligations. This applies when hiring someone from an EU country, a skilled worker from a non-EU country, or when employing someone in a country where the company does not have its own subsidiary.

Each scenario involves different verification processes, responsibilities, and documentation. Companies that wait until after a candidate has been selected to address these issues risk avoidable follow-up inquiries and organizational delays.

This article addresses the employment of international employees in Germany. The secondment of German employees abroad is subject to its own tax, social security, and labor law requirements and will not be covered in depth here.

The key question before any international hire is therefore: Have all responsibilities been clarified before the employee begins work?

First, correctly classify the case: country of origin, role, and employment model

The review process begins with a few basic details: nationality, location of assignment, planned duration of employment, job duties, and employment model. These determine which departments are involved and what documentation is required.

Distinguish between the EU, EEA, Switzerland, and third countries

Cases involving the EU, the European Economic Area, and Switzerland must be distinguished from those involving third countries. However, a comprehensive assessment of residency status must always take the specific circumstances into account.

For prospective workers or skilled professionals from third countries, the Federal Employment Agency must, in most cases, approve their admission to the German labor market. It reviews the requirements for employment and, if the conditions are met, issues its approval to the relevant diplomatic mission abroad. Employers or private service providers cannot override this official decision.

Define the Position, Qualifications, and Employer’s Role

Before beginning the recruitment process, companies should document the job requirements, the intended occupation, the place of employment, the contract term, and the employer’s internal role. Nationality, destination country, qualifications, employment model, document status, and required translations should also be included in this case assessment.

In the case of regulated professions or an unclear qualification status, the relevant authorities should be involved at an early stage. This allows for the identification of outstanding requirements before the search, selection, and contract preparation have progressed too far.

Implementing International Employment in Compliance with the Law: The Six Steps

The specific requirements for each step depend on the individual case and the relevant authorities. A documented process ensures clear handoffs and makes pending decisions transparent.

1. Identify the need: Define the scope of the review

Assess the initial situation: Determine the review process.

Companies determine which qualifications are required, in which country the employment will take place, and how long the assignment is planned to last. At the same time, it must be determined what resources the HR department, payroll, and the relevant business unit can provide internally.

Next, define the desired employer role. Direct hiring, temporary staffing, Recruiting Process Outsourcing (RPO), or Employer of Record (EOR) may be considered depending on the needs and employment arrangement. RPO pertains to the recruiting process, while an EOR can assume the role of employer. Defining these roles early on prevents the search, administration, and employer obligations from becoming intertwined.

2. Attracting Candidates: Communicating Requirements Transparently

Document the profile: Tailor the selection process.

The search and selection should be based on an agreed-upon requirements profile. It describes the job duties, qualifications, experience, work location, and realistic conditions of employment.

During the selection process, technical aptitude, professional experience, and motivation can be evaluated together. For international hires, this also includes determining whether existing documents provide verifiable proof of qualifications and whether translations are required. The evaluation should be documented and coordinated with the relevant department. This provides recruiting, the HR department, and external support with a common working basis.

3. Clarify Entry: Check Requirements Before Starting Work

Check Authorizations: Prepare for a Decision.

Residence permits, work permits, potential labor market admission, document status, and official jurisdictions constitute a separate review process. For third-country nationals, the official information from the Federal Employment Agency regarding labor market admission is authoritative.

A preliminary approval procedure can be used so that the Federal Employment Agency verifies whether the labor market requirements are met and whether the position can be filled by a foreign worker. Process support can coordinate documents or prepare for interactions with authorities. It does not prejudge the decision. The competent authority reviews the application and subsequently decides on the specific case.

4. Establishing the Employment Relationship: Coordinating the Contract, Payroll, and Social Security

Assign Responsibilities: Ensure Accurate Payroll Processing.

International employment involves more than just the employment contract. Payroll processing, tax withholding, social security contributions, and any reporting requirements must also be tailored to the specific case.

Companies should document who provides the necessary information, who is responsible for payroll processing, and how inquiries are handled. The chosen form of employment influences this division of responsibilities. Therefore, the HR department, payroll, the relevant business unit, and, if necessary, external consultants must all use the same documented baseline. Specific requirements arise from the employment situation and the decisions of the relevant authorities.

5. Preparing for Arrival: Combining Onboarding and Integration

Planning Transitions: Ensuring Work Readiness.

Company-led onboarding and administrative arrival matters require separate responsibilities but must be timed to align. The workplace, access, orientation, and team communication are the company’s responsibility.

Organizational handoffs can be facilitated as agreed. This includes, for example, coordinating documents, appointments, housing, and integration issues. A designated contact person consolidates outstanding issues and coordinates the next handoff point. This ensures the new employee knows who to turn to while the department prepares for the start of their role.

6. Manage Deadlines: Document Supporting Documents and Review Changes

Monitor Status: Identify the Need for Action.

The case file remains relevant after the employee starts work. Companies should document expiration dates, submitted supporting documents, open inquiries, external appointments, and feedback from authorities in a traceable manner.

Changes to job duties, work location, duration of employment, or employment model may require a re-evaluation. The same applies if personal or organizational details relevant to the employment case change. Companies therefore designate who is responsible for receiving changes and forwarding them to internal or external departments. The responsible department decides which further steps are necessary in each individual case.

Who can support the process? Clearly assign responsibilities

Who can help my company employ workers from abroad in compliance with the law?

The answer depends on the specific task: Government agencies decide on administrative procedures. Private partners can assist with the search, preparation, coordination, and employment administration, depending on the assignment.

Government Agencies and Official Advisory Services

The Federal Employment Agency and its network of partners support companies in recruiting and employing foreign workers and skilled professionals. As part of the labor market admission process, the Federal Employment Agency reviews the relevant requirements.

The Foreigners’ Registration Office or the state-level Skilled Worker Immigration Office is a central point of contact for employers. Their responsibilities may include entry requirements, recognition procedures (if applicable), approval from the Federal Employment Agency, and other requirements under immigration law. Which agency is responsible depends on the individual case.

Private Support Throughout the Employment Process

The roles of private support providers should be clearly distinguished from one another:

With an Employer of Record, day-to-day operational management remains with the company, while the agreed-upon employer functions and administrative tasks are handled by the EOR. This model also does not replace an official decision and does not relieve the parties involved from verifying their respective obligations.

Concise Checklist Before the Start of Employment and During Employment

This checklist supports structured case handling. It does not replace a comprehensive review of the legal requirements. Each item must be assigned, on a case-by-case basis, to the company, the employee, the competent authority, or a designated support provider.

Record nationality and work location, duration of employment, and employment model. Designate a person responsible for internal coordination.

Document qualifications and intended occupation. Verify the status of documents and record any required translations. If questions remain, determine the responsible authority.

Document required checks, outstanding inquiries, and the competent authority. Record external appointments with responsible parties and the processing status.

Tailor the employment contract, payroll, tax withholding, social security, and any reporting obligations to the specific case. Document in writing the division of responsibilities between the company and the designated support provider.

Prepare the workspace, access, orientation, and team communication. Coordinate administrative arrival matters separately and specify the next handover point.

Review relevant changes to job duties, work location, duration, or employment model. Continuously document supporting evidence, feedback, and expiration dates.

Verify that the company, employees, government agencies, and external support providers are aware of their respective responsibilities. Delegate employer obligations only where the chosen model and agreement provide for such delegation.

If a specific case is ambiguous, consult the most current official guidelines or seek qualified legal advice.

Conclusion: International employment requires clear handoffs

Legal certainty does not mean having to resolve every special case internally, but rather managing responsibilities, documentation, and handoffs clearly and early on. Companies should first classify the country of origin and the employment model. Afterward, regulatory reviews, recruiting, contract preparation, payroll, and onboarding can be coordinated in an organized manner.

Private support services can handle or coordinate individual process steps. However, responsibility for each task must remain clearly defined.

2. Kandidaten gewinnen: Anforderungen transparent kommunizieren

Profil dokumentieren: Auswahl ausrichten.

4. Arbeitsverhältnis aufsetzen: Vertrag, Payroll und Sozialversicherung abstimmen

Pflichten zuordnen: Abrechnung absichern.
